1. Assumption of Risk
The Member acknowledges that boxing, fitness training, and related activities — including but not limited to sparring, weightlifting, conditioning exercises, and use of gym equipment — involve inherent risks that could result in serious injury, disability, or death. The Member voluntarily and knowingly assumes all such risks, both known and unknown, associated with participation in these activities at Croydon Boxing Gym Ltd. (“the Gym”).
2. Waiver of Liability
To the fullest extent permitted by law, the Member agrees to release, waive, discharge, and hold harmless Croydon Boxing Gym Ltd., its owners, directors, employees, coaches, trainers, and agents from any and all claims, demands, causes of action, lawsuits, or liability for any personal injury, illness, property damage, or loss that may result from participation in activities at or sponsored by the Gym, except where such injury, illness, or damage is caused by the negligence of the Gym or its staff.
3. Indemnification
The Member agrees to indemnify and defend the Gym, its owners, directors, employees, trainers, and agents against any and all claims, lawsuits, or damages (including legal fees) resulting from injuries or damages sustained by the Member, or caused by the Member, during participation in activities at the Gym or related events.
4. Medical Release
The Member represents and warrants that they are physically fit and have no undisclosed medical condition that would prevent safe participation in boxing, fitness training, or related activities. The Member agrees to:
- Consult with a physician before beginning any exercise programme;
- Follow the advice of medical professionals;
- Promptly notify the Gym of any changes to their health or medical condition.
In case of emergency, the Member authorises the Gym to obtain medical treatment on their behalf at the Member’s expense, and releases the Gym from liability resulting from any failure to receive prompt medical care.
5. Equipment and Facilities Use
The Member agrees to use the Gym’s equipment and facilities responsibly and in accordance with any rules, guidelines, or instructions provided. The Member understands that improper or reckless use of equipment, or failure to follow instructions, may result in injury or property damage, for which the Member assumes full responsibility.
6. Code of Conduct
The Member agrees to adhere to the Gym’s rules and code of conduct, including respect for other members, staff, and property. The Gym reserves the right to terminate membership if a Member engages in unsafe, inappropriate, or disruptive behaviour.
7. Photography/Video Release
The Member agrees that the Gym may take photographs or video recordings during training sessions or events and may use them for marketing, promotional, or educational purposes without compensation. For participants under 18, separate written or verbal consent from a parent/guardian is required for photography or video recording. Members or parents/guardians may withdraw consent at any time by notifying the Gym in writing.
8. Personal Belongings
The Member acknowledges that the Gym is not responsible for lost, stolen, or damaged personal belongings while on the premises, except where such loss or damage is caused by the negligence of the Gym. Members are responsible for safeguarding their valuables.
9. Cancellation Policy
The Member understands that they may cancel their membership by providing written notice in accordance with the Gym’s membership cancellation policy. Refunds or credits for unused membership time will be handled according to the terms set out in the separate membership agreement.
10. Minors
If the Member is under the age of 18, a parent or legal guardian must sign this waiver on behalf of the minor. By signing, the parent or guardian acknowledges and agrees to all terms contained within this waiver and assumes full responsibility for the minor’s participation at the Gym.
11. Severability
If any portion of this waiver is deemed invalid by a court of law, the remainder shall remain in full force and effect. This waiver constitutes the entire agreement between the Gym and the Member regarding the subjects covered and may not be modified except in writing signed by both parties.
12. Governing Law
This waiver and any disputes arising out of or in connection with the Member’s participation in activities at the Gym shall be governed by the laws of England and Wales.
